1. OBJECTIVE

1.1 This document sets out the pre-contractual information relating to contracts concluded at a distance in the online store www.kontrolsat.com, referred to in article 4 of Decree-Law no. 24/2014 of February 14, and all subdomains/ sub-websites.

1.2 The domain www.kontrolsat.com is owned by KONTROLSAT UNIPESSOAL, LDA, headquartered in Vila Nova de Gaia, legal person n° 509043267, which is also its registration number at the Commercial Registry Office of Vila Nova de Gaia, of hereinafter abbreviated to KONTROLSAT.

1.3 KONTROLSAT reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable legislation, without the need for any prior notice.

1.4 Both browsing the website www.kontrolsat.com, its subdomains and sub-websites, as well as the purchase of any product at those addresses, presupposes acceptance of the present information and General Conditions of Use contained on this page.

2. Conditions of use of www.kontrolsat.com

2.1 The User undertakes to use this website in compliance with the provisions of the applicable legislation, refraining from using the website for activities contrary to the law, morals and good customs, or the rights and interests of third parties.

2.2 The www.kontrolsat.com website may have links to other websites, which may contain useful information/tools for its users. These general conditions will not apply to third-party websites. As such, if the user visits another website, redirected from our website, he must read its privacy policy.

4. Intellectual Property

4.1 All content and information contained in www.kontrolsat.com and its subdomains are the property of KONTROLSAT and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos contained in that website is subject to its prior authorization in this regard.

5. Information on Products and Prices

5.1 KONTROLSAT takes into account the information regarding the essential characteristics of the products through technical descriptions shared by its suppliers, and photographs that illustrate the products sold, in strict respect for the best standards in the market.

5.2 The retail prices indicated on www.kontrolsat.com and its subdomains are presented in euros. VAT is included in all quoted prices - except for reseller accounts. The costs of the shipping service may be borne by the user and buyer, and are added to the total value of the selected products.

5.3 The user will be informed of these charges before confirming his order and completing the purchase process. KONTROLSAT reserves the right to change prices at any time. However, KONTROLSAT undertakes to apply the rates and prices indicated when placing the purchase order.

5.4 In the event of a computer, manual, technical error, or of any other origin, which causes a substantial change not foreseen by KONTROLSAT in the public sale price, in such a way that it becomes exorbitant or manifestly derisory, the request for purchase will be considered invalid and void.

5.5 The prices of the products available on www.kontrolsat.com are valid for purchase orders made through www.kontrolsat.com, and coincide with those shown in the physical KONTROLSAT store(s).

6. Payment Methods

6.1 Kontrolsat has several payment methods available, with no additional fees and of an immediate nature. The available methods are: Multibanco Reference, MBWAY, PayPal Credit Card & Klarna - Payment in 3 installments without interest. 7. General Warnings

7.1 Promotions are limited to existing stock. Stock is accounted for with the issuance of the Invoice-Receipt, so there may be sudden stock outages, with no possibility of restocking at the promotional price. In this case, the order will be canceled and the amount refunded.

7.2 We are not responsible for typographical errors or image errors, as well as changes in the characteristics provided/indicated on the equipment by suppliers, brands or legal distributors. The general conditions of use and all information on our homepage may be changed at any time.

7.3 We do not provide software, indications and configurations for the use of each of our products - this knowledge is specialized and should always be reviewed by an installation professional in the area.

7.4 Please note that all our products have exclusively legal purposes. We are not responsible for the use that each customer makes of the product and we disapprove any illegal use of the same or fraudulent act.

7.5 After completing the exchange / guarantee / return process, the customer has a period of 30 days to collect the equipment after registering the document. The absence of the survey after the deadline is considered abandonment under the terms of artº 1267/1a of the Civil Code.

7.6 Kontrolsat reserves the right to treat the equipment as abandoned if it remains in its possession after 90 days from the conclusion of the intervention and communication to the customer. Abandoned equipment will be donated, sold or used as Kontrolsat deems most convenient.

8. Free Resolution and Returns

The consumer has a period of 14 days, counting from the day he acquires physical possession of the goods or the day he acquires physical possession of the last good, in the case of several goods ordered in a single order and delivered separately, to proceed to the return of your order, and without the need to indicate the reason.

8.1 Physical Store Acquisitions

Kontrolsat intends to adopt a Satisfaction Policy for its customers, following the European guidelines for the Return Policy.

Due to the abusive adoption of the previous refund policy, as of December 15, 2018, Kontrolsat will no longer provide cash refunds for equipment purchased in store, with exceptions provided by law.

We remind customers that we will maintain the store's internal credit refund policy to use in a future purchase, in the cases set out below:

8.2 Distance Purchases

The return or exchange of equipment purchased remotely is protected by Portuguese law, and therefore we will maintain the refund in cash, in the same cases mentioned:

8.3 Difference between Return and Warranty

In no way should the Return Policy be confused with the Warranty Policy. The return is part of the free will of the Customer, while the guarantee is part of a manufacturing fault of the equipment. Since, in the rare exceptions in which a product is sent with a factory defect, KONTROLSAT undertakes to exchange it for an equal one as soon as possible after notification of non-conformity within the legal terms and deadlines for this purpose.

9. Warranty

The products sold by KONTROLSAT at www.kontrolsat.com are covered by the Legal Regime of Consumer Rights in the Purchase and Sale of Digital Goods, Content and Services, approved by Decree-Law No. 84/2021, of October 18, in its version current, and its compliance is guaranteed for a period of 3 (three) years from the date of delivery of the good, in the case of new or refurbished goods. In the case of used goods, the guarantee of conformity has a period of eighteen months after delivery of the good, unless a longer period is indicated.

You can exercise your rights by going to a KONTROLSAT store with the respective product, complete and without signs of misuse and the corresponding purchase invoice, by contacting the KONTROLSAT Customer Service line - by email you can direct your questions to rma @kontrolsat.com or through option 3 of our telephone contact, or by following the steps in the RMA (Return Merchandising Authorization) form .

9.1 Warranty Terms and Resolutions

The repair period must not exceed 30 days, with the exception of cases in which the specificity and processes inherent to its repair are so complex that an extension of the period is justified.

In certain products marketed by KONTROLSAT, the brands provide direct assistance, without the need for any cost charged to the customer with collection and delivery of the goods. Please contact [email protected] for the correct procedures for your product.

The product under warranty can be repaired or replaced by an equivalent or superior product from the manufacturer. In case of complete replacement, you can request an internal credit note to purchase another product in our KONTROLSAT store(s)

9.2 Other Warnings

In case of difficulties in installing/using any product, start by making sure that you are following all the instructions contained in the manufacturer's Instruction Manuals, namely regarding the installation and use of the appropriate software. If the problem persists, contact the manufacturer directly or seek technical help from a professional in the area.

Due to the misuse of appliances, thunderstorms and other factors that influence the electrical network of the house and inherently break the appliances, they lose the right to the warranty.

10. Shipping & Customer Responsibility

KONTROLSAT subcontracts the most efficient transport service for its operation, with no possibility for the customer to select different companies or collect from our store with an external transport service. The delivery times displayed on the website are only estimates taking into account the normal functioning of the service, therefore KONTROLSAT is not responsible for occasional delays inherent to the transport company's logistical service.

It is KONTROLSAT's sole responsibility to ship orders in new condition, without signs of use and with packaging in good condition.

It is the CUSTOMER's sole responsibility to verify the status of the order at the time of receipt, with the transport courier. In case it is impossible to review the product, always and without exception, put the observation on the transport note "Subject to verification - packaging in poor condition" . You should only accept a product as you would pick it up from a physical store - without any folds, marks, holes or tears.

If you accept an order without proper verification and the product is later found to be non-compliant and/or damaged, you will lose the right to free resolution.

11. Alternative Dispute Resolution

The alternative resolution of disputes is the possibility that all consumers have at their disposal to appeal to official entities that help them in the resolution, or guidance of any conflict, before opening litigious processes in the Courts. As a general rule, the procedure is as follows: the customer asks an impartial third party to act as an intermediary between him and the trader who is the target of his complaint. The intermediary can suggest a solution to your complaint, impose a solution on both parties, or bring the parties together to find a solution.

Perhaps you know the concept of alternative dispute resolution by another name: 'mediation', 'conciliation', 'arbitration' or 'competent commission in the context of consumer disputes'.

Alternative dispute resolution is, as a rule, less expensive, less formal and faster than the judicial route.
